Please read these Terms of Use ("Terms of Service", "Terms of Use", "Terms",) carefully before using the Clan Dog website (www.clandog.co.uk) (the "Service" or "Site") operated by CLAN DOG LTD ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

By using the Service, you acknowledge and agree that all intellectual property rights in the content and materials provided on the website are the property of CLAN DOG LTD. You shall not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from or through the Clan Dog website.

You may, however, print or download one copy of the materials on the Clan Dog website for your personal, non-commercial use, provided that you do not remove any copyright or other proprietary notices.

Any unauthorized use of the content and materials on the Clan Dog website may violate copyright laws, trademark laws, and other applicable laws and may result in legal consequences.

As a user of the Clan Dog website, you are responsible for your conduct while accessing and using the Service. You agree to use the Service only for lawful purposes and in accordance with these Terms of Service.

You agree not to use the Clan Dog website:

To post or transmit any material that is infringing, defamatory, obscene, indecent, abusive, offensive, harassing, violent, or otherwise objectionable
To impersonate or attempt to impersonate Clan Dog, a Clan Dog employee, another user, or any other person or entity

To use any robot, spider, scraper, or other automated means to access the Service or any materials on the Service without our express written permission (search engines excluded)
To collect or harvest any personally identifiable information, including account names, from the Service
For any commercial purpose without our prior express written consent

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this section, including without limitation, removing the offending content from the Service and terminating the account of such violators. We also reserve the right to take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Service. Upon termination, your right to access and use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

We reserve the right to refuse service, terminate accounts, or remove or edit content in our sole discretion.

5. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms of Service or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in accordance with the rules of the United Kingdom.

The arbitration shall be conducted by a single arbitrator, appointed in accordance with those rules. The seat of the arbitration shall be in the United Kingdom. The language of the arbitration shall be English.

You and CLAN DOG LTD agree that any dispute arising from or related to these Terms will be resolved exclusively through final and binding arbitration, rather than in court. You and CLAN DOG LTD waive any right to participate in a class-action lawsuit or class-wide arbitration.

Notwithstanding the above, CLAN DOG LTD reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

Any claim must be filed within one year after the occurrence giving rise to the claim, or the claim will be forever barred.

These Terms of Service shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. This section on Dispute Resolution shall survive any termination of these Terms.

6. Limitation of Liability

In no event shall CLAN DOG LTD, its directors, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the Service
Any conduct or content of any third party on the Service
Any content obtained from the Service
Unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

To the maximum extent permitted by applicable law, CLAN DOG LTD's aggregate liability for any claims arising out of or related to the Service or these Terms of Service, whether in contract, tort, or otherwise, will be limited to the amount you have paid us, if any, in the twelve (12) months preceding the claim.

You acknowledge and agree that the above limitations of liability are a fundamental part of the bargain between you and CLAN DOG LTD, and that CLAN DOG LTD would not provide the Service to you without such limitations.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. This section on Limitation of Liability shall survive any termination of these Terms.

7. Advice

Advice is only offered via our members only Facebook group, the monthly members Q&A sessions, and the members only message board. We will not offer tailored advice via any of our social media channels, and any advice offered will be generic and may not fully apply to your specific requirements. If you require specific requirements then we suggest a Clan Dog Subscription or booking a 1-2-1 session.

8. Complaints

If you would like to make a complaint then please contact us at hello@clandog.co.uk. Complaints sent through other channels such as social media may not be recognised.

9. Accounts

When you create an account on our website, you must provide information that is accurate, complete, and current at all times. Failure to do so is a breach of the Terms, which may result in immediate termination.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Our website may contain links to external third-party websites that are not owned or controlled by us. We provide these links for your convenience and to enhance your browsing experience. However, please note that we do not endorse, sponsor, or recommend these third-party websites and we are not responsible for their content, privacy policies, or practices.

11. Subscriptions

Also referred to as "Membership"

A subscription is a recurring payment to Clan Dog for access to premium features such as members only videos, Q&A sessions as well as access to a supportive community.

All subscriptions remain valid until cancelled, refunds are typically not offered on any subscription service unless there has been a technical fault.

If you cancel your membership, you will retain access until the end of the billing period. This date will be displayed once you have cancelled a membership which can be viewed under your profile.

How to cancel your membership:

Login to your account
Navigate to your "profile"
Navigate to "your subscriptions"
Click the "cancel" button
Your subscription will then be fully cancelled on the date specified and you won't be billed again

If you wish to have your subscription fully cancelled immediately, you can submit a request to hello@clandog.co.uk (You will lose all benefits as soon as this process has completed)

How do I reactivate a suspended or cancelled subscription?

Log in to your account
Navigate to your "profile"
Navigate to "your subscriptions"
Click the "Re-Start" button
Your subscription will be active again and you will be charged on the date shown in schedule with the billing plan

If your subscription is fully cancelled and the "your subscription" page states that you don't have any subscriptions then you will have to start a new one as you did originally.

12. One to One Sessions

Also referred to as "1-2-1"

A 1-2-1 session is a one to one consultation with one of the trainers at Clan Dog.

1-2-1 sessions are for those who are seeking personalised advice based on specific circumstances.

These sessions can be carried out in person throughout central Scotland (or at our discretion) or remotely via zoom. If you are further than central Scotland and we agree to come to you, you may be liable for extra travel costs.

13. Changes to terms

We reserve the right to modify or update these Terms of Service at any time, and it is your responsibility to regularly check for changes. By continuing to access or use our website after any modifications, you agree to be bound by the revised Terms of Service.

We may notify you of any material updates to these Terms of Service by email or by posting a notice on our website. If you do not agree to the updated terms, you may terminate your account and stop using our website. Your continued use of the website after the revised terms have been posted shall be deemed an acceptance of the updated terms.

We may, at our sole discretion, add, delete, or change any aspect, feature or functionality of this website, or suspend or discontinue any part or all of it, without notice or liability. We reserve the right to modify or discontinue our website or any service, or restrict access to certain features of our website, with or without notice and without liability to you or any third party.

By accessing or using our website, you agree that we shall not be liable to you or any third party for any modification, suspension, or discontinuation of our website or any service. We further reserve the right to modify or discontinue any part of our website, or the services or products we offer, at any time without prior notice to you.
